The Law in Georgia

The law in Georgia is crystal clear: Intimidating Voters is a Crime.

State laws protect voters, poll workers, and election officials from intimidation and aggressive behavior.

These laws prohibit harassment, place severe limits on who can observe elections and keep aggressors away from polling locations.

Actions that have the effect of intimidating voters are illegal, period.

Poll Workers

Intimidation is Illegal

Georgia law provides strong protections for poll workers and election officials. It is a felony under Georgia law to threaten a poll worker or election official, use violence against a poll worker or election official, or attempt to prevent a poll worker or election official from doing their job in any way. Ga. Code § 21-2-566(1)-(2).

Poll Watchers

Who can be a poll watcher?

  • Watchers must be identified to officials before the election
  • Watchers must be confirmed in writing and submitted to officials before Election Day

What can poll watchers do?

Poll Watchers may not:

  • Interfere with the election process
  • Talk to voters or use cell phones
  • Take photos or record videos
  • Campaign for candidates

Voter Intimidation

Voter Intimidation is Illegal

Examples of intimidation:

  • Confrontation of voters
  • Offensive language
  • Raised voices
  • Blocking entry to a polling place
  • The threat of physical force
  • Firearms are prohibited

Know Your Rights

You have the following rights:

  • To vote in-person or by mail.
  • To assistance if needed.
  • To be directed to your polling location.
  • To vote if you are in line when the polls close.
  • If denied a regular ballot, you have the right to a provisional ballot.
